The recent ruling by the Supreme Court granting local government full financial autonomy has sparked debates across the country. The ruling, which many see as a pivotal moment for local governance, grants increased autonomy to Local Government (LG) Chairmen. The question now is whether this ruling will lead to a meaningful change or simply lead to misuse of power.

It ordered the Federal Government to commence the direct payment of funds into exclusive accounts of local governments.
The court also barred state governors from dissolving democratically elected local council chairmen, stating that doing so, would amount to a breach of the 1999 Constitution.
The court made the declaration while ruling in the suit filed by the Federal Government through the Attorney General of the Federation (AGF), Lateef Fagbemi.
“We hope LG Chairmen have not been handed an opportunity to increase their convoys,” says political analyst, John Adewale. “We need to see real improvements at the LG level, not just more pomp and pageantry.”
The Current State of Local Governance
Before the ruling, the power dynamics between state governors and LG Chairmen were often imbalanced. Many LG Chairmen were seen driving around with large convoys, a display of power that did not always translate into effective governance.
According to a report by the National Bureau of Statistics, 65% of LG budgets are spent on administration, leaving little for developmental projects.

The Supreme Court ruling aims to give LG Chairmen full control over their budgets and decision-making processes. This autonomy could potentially lead to better governance at the local level, but only if used correctly.

A Political Scientist, Dr. Miriam Okoro, weighs in: “This ruling is a double-edged sword. It can either empower LG Chairmen to make positive changes or give them more room for corruption and waste.”
Legal Perspectives on the Ruling
Two prominent lawyers have weighed in on the potential implications of the ruling.
Barrister Olumide Idowu, a constitutional law expert, expresses concern: “While the autonomy granted to local governments is a step in the right direction, it is crucial to establish robust oversight mechanisms to prevent the misuse of power. Without proper checks and balances, the risk of corruption and administrative inefficiency increases significantly.”
On the other hand, Human Rights Lawyer, Barrister Grace Adebayo, offers a more optimistic view: “This ruling empowers local governments to take charge of their destinies. It is an opportunity for grassroots development and closer accountability to the people. However, civil society and the judiciary must remain vigilant to ensure transparency and accountability.”
Potential Misuse of Power
One major concern is the potential for LG Chairmen to misuse their newfound power. The creation of unnecessary offices, such as a portfolio for the Chairman’s wife, is a common fear among citizens.
“We hope an office for the wife of the Chairman will not be created with a full portfolio,” says a community leader, Aisha Bello. “This is not what local governance should be about.”
Another worry is the possibility of LG Councillors also indulging in similar excesses. The creation of offices for the wives of Councillors and the use of convoys could become more prevalent.
Conflict Between Governors and LG Chairmen
The new ruling may also lead to conflicts between state governors and LG Chairmen. The autonomy granted to LG Chairmen could be seen as a threat to the governors’ authority, leading to unnecessary tests of strength.
“I hope we will not see unnecessary tests of strength between governors and LG Chairmen,” says Adewale. “Such conflicts will only hinder progress.”
Accountability and Oversight
One crucial aspect of this new arrangement is the need for accountability and oversight. Without proper checks and balances, the autonomy granted to LG Chairmen could easily be abused.
Transparency International reports that corruption at the local government level remains a significant issue, with over 40% of local government funds being misappropriated annually.
“We need to ensure that these LG Chairmen are held accountable for their actions,” says Dr. Okoro. “Regular audits and public reporting can help in this regard.”
Citizen Engagement and Participation
For local governance to improve, citizens must be actively involved in the decision-making process. Public forums, town hall meetings, and other forms of engagement can help ensure that the needs of the community are being met.
“We hope we will not call out these LG Chairmen later on,” says Bello. “We must be proactive and hold them accountable from the start.”
Examples of Successful Local Governance
Despite the challenges, there are examples of successful local governance that can serve as models. In Lagos State, for instance, the LG Chairman of Surulere has been praised for his effective use of funds in improving infrastructure and public services.
“Such examples show that with the right leadership and accountability, LG Chairmen can make a real difference,” says Adewale.
A Call for Vigilance and Participation
The Supreme Court ruling offers a significant opportunity for local governance in Nigeria. However, it also comes with risks. Citizens must remain vigilant and engaged to ensure that LG Chairmen use their newfound autonomy for the benefit of the community.
“We must ask these questions now because of the current political structure and the politicians we have,” concludes Adewale. “Only then can we hope for real change at the local government level.”
