Oscar-winning actor Jamie Foxx finds himself at the center of a legal dispute as he is sued for alleged s*xual assault at a New York rooftop bar in 2015.
The lawsuit, filed on Wednesday, claims that Foxx, accompanied by Mark Birnbaum, the bar’s owner, assaulted a woman identified as Jane Doe in a secluded area of the Catch NYC rooftop lounge.

Seeking a photo opportunity, the woman’s friend approached Foxx around 1 a.m., initiating a series of compliments from the actor.
The suit details Foxx’s remarks, including comments on the plaintiff’s physique and a comparison to actress Gabrielle Union.
The situation escalated when Foxx allegedly took the woman to a more secluded part of the rooftop, where he is accused of groping her br*asts and, against her will, placing his hands underneath her pants, touching her v*gina and anus.
Shocked and caught off guard, the plaintiff attempted to step away, but the suit claims that Foxx persisted in his inappropriate actions.

What adds complexity to the case is the assertion that a security guard witnessed the incident but failed to intervene. The woman’s friend eventually found her, prompting Foxx to cease his actions and walk away.
The lawsuit, filed under New York’s Adult Survivors Act, aims for compensation due to pain, suffering, emotional distress, anxiety, and humiliation. It contends that the woman sought medical treatment as a result of the alleged assault.
The legal action extends beyond Foxx to include Birnbaum and Catch NYC as defendants. The suit alleges that the establishment and its owner not only allowed the assault to occur but also failed to adequately supervise their employees.
This case is among several others filed under the Adult Survivors Act, which provided a one-year window for filing sexual abuse claims that would otherwise be barred by the statute of limitations.
As the deadline approaches, this lawsuit brings attention to the importance of addressing such allegations and seeking justice within the legal framework. At the time of reporting, representatives for Jamie Foxx have not responded to requests for comment.
