Court Upholds Ban on Medical Treatments for Transgender Minors

The Texas Supreme Court has ruled in favour of a controversial law that prohibits medical treatments for transgender minors, such as puberty blockers and hormone therapies.

The ruling, delivered on Friday, supports the legislation signed by Republican Governor Greg Abbott in June 2023, which went into effect on September 1, 2023.

Law Aimed at Regulating Medical Treatments

The law restricts doctors from performing gender transition procedures or treating gender dysphoria in individuals under 18 years old. The decision has sparked a significant response from both supporters and opponents.

Justice Rebeca Huddle, writing for the majority, stated, “Parents have a significant right to make decisions about their children’s healthcare without government intrusion, but this right is not absolute.”

She emphasized that the legislature has the authority to regulate medical practices, especially when parents’ decisions might conflict with the state’s interests.

Legal Battles and Injunctions

Opponents of the law, including parents, doctors, and advocacy groups, took legal action to stop its enforcement. Initially, a judge issued an injunction, ruling that the law likely violated the Texas Constitution.

However, the Texas Supreme Court overturned this decision, declaring the law constitutional.

Dr. Sarah Miller, a pediatric endocrinologist, expressed her concerns: “This law undermines the medical care we provide to our transgender patients. It disregards the expertise of medical professionals and the needs of these children.”
